Kwara tribunal nullifies PDP lawmaker's victory, upholds another
The Justice Bitrus Sanga- led panel held that election was inconclusive in two wards of Alanamu and Oloje wards in the constituency. Mallam Aiyelabegan Kayode of the Action Congress of Nigeria (ACN) had petitioned the tribunal to contest the declaration of Abdulfatah in the poll for alleged substantial noncompliance with the provisions of the Electoral Act. The three-man tribunal observed that form EC8C, being the statements of result declared at the wards were dated and signed on April 27, while the final result (form EC8E), a product of form EC8C was dated, stamped and signed April 26.
The panel added that it wondered why the final result was declared on April 26 when results from the two wards were still being collated. Reading the judgment, Justice Sanga, said that the panel could not close its eyes at the irregularity despite the elucidated explanation of the INECs witnesses that the mistake was human and it was as a result of pressure. The tribunal therefore held that elections in the two wards were inconclusive as at the time the final result was announced.
We therefore ordered that INEC should conduct fresh election in the two wards of Alanamu and Oloje wards within 90 days of this judgment. It is therefore after the result from these wards that the INEC should determine the true winner of the seatÓ.
