KWHA endorsed dissolution of Local Government Councils

Similarly the Legislature has given the State Governor the nod to constitute Transitional Implementation Committee in all the 16 Local Government Councils in the State.

The endorsements followed the appearance of the State Attorney General and Commissioner for Justice Barrister Kamaldeen Ajibade to clarify his earlier position before the House on September 6th 2016, that the constitution of TIC was now illegal based on the Supreme Court judgement in respect of Osun State.

Reading the resolutions of the House, the Speaker Dr Ali Ahmad said the House resolved to endorse the dissolution of the councils and constitution of TIC based on the submissions of the Attorney General of the State and enjoined the Governor to ensure that the new TIC at the third tier of government in the State ,clears the backlog of salary arrears of workers in the Local Government to ameliorate the plights.

The Speaker said that with the explanation of the Attorney General, the dissolution and appointment of TIC at the Local Government Councils by the Governor were in accordance with the provisions of State Local Government Laws as amended.

The Attorney General had earlier briefed the House that Section 18 Sub section 5 of the Kwara State Local Government Law as amended, empowers the Governor to dissolve the Local government Councils, while section 18 sub section 8 of the State Local Government Law equally allows the Governor to appoint a caretaker Committee to administer the affairs of the Councils.

Barrister Ajibade disclosed further that the Supreme Court's ruling on TIC in respect of Osun State was based on the fact that Osun State then, had no law providing for constitution of TIC, saying that section 18 sub section 5 , 8 of the Kwara State Local Government Law as amended, empowers the Governor to dissolve Councils and constitute TIC to administer the affairs of the Local Government Councils in the State.
