Farmer remanded over unlawful possession of gun
In Bukoro community via Gwanara in the Baruten Local Government Area of Kwara State, a 22-year-old farmer, Nicholas Ilani, who was allegedly found in possession of firearm, has been remanded at the Federal Medium Security Prison, Mandula Area, Ilorin.
The order to remand the accused was made by an Ilorin Magistrates’ Court before which he appeared on a three-count charge of criminal intimidation, causing hurt and unlawful possession of firearms.
The offences contravene Sections 397, 245 of penal Code and 5(3) of Firearms Act Cap F28, Vol7 law of the Federation of Nigeria.
Nicholas was arrested on April 14, 2012 having been alleged to have criminally conspired with his brother (now at large) and threatened to kill a cattle rearer with his (accused) gun.
The accused was arrested following a report at the Bukoro Police Out-Station, Gwanara by the victim, Adamu Bature who lives at Areguna village, via Kare, Kwara State, that the accused and his brother connived to injure him.
According to the victim, the accused along with the other at large suddenly came out from the bush and started beating him.
"They used the butt of their dane gun to hit me on my head and I sustained injuries on my head", he said.
Police First information Report (FIR) on the matter stated that investigation conducted at the State Criminal Intelligent Department (SCID), Ilorin, revealed that the accused committed the alleged offences.
The prosecutor, Sergeant Matthew Ologbonsaye, who informed the court that investigation into the case was yet to be completed, objected to the bail of the accused and urged the court to remand him at prison custody, Ilorin, pending the outcome of the investigation.
In his ruling, Magistrate I.A. Dasuki stated that the offence for which the accused was brought before the court was not ordinarily bailable and that when investigation was yet to be completed the proper rule was to remand the accused.
Consequently, the court ordered that the accused should be remanded at the Federal Medium Security Prison, Mandala, and Ilorin adjourned the case for further mention.
