Tribunal grants ACN prayer for substituted service
The applicant, who is challenging the victory of the respondent for the Ilorin South state constituency, said all efforts to serve Yusuf had been abortive.
Counsel to the ACN, Mr Muideen Ganiyu told the Justice Bitrus Sanga led three- man tribunal in an ex parte motion that granting the order would hasten speedy dispensation of the case.
‘I urged the tribunal to grant our application to serve the respondent through substituted service and to paste the petition on the gate of the respondent in order to move forward on case”, he said.
In his ruling, Sanga granted the prayer of the applicants to serve the respondents its petition through substituted service.
It also granted an order to the petitioner to paste the petition with all other front-loaded processes and other court processes to be filed in the petition on the gate of the respondent or alternatively in the court premises where the tribunal conducted its proceedings.
The News Agency of Nigeria reports that ACN and its candidate in the April 26 State House of Assembly election, Tajudeen Mustapha are challenging the declaration of PDP candidate as winner of the election in Ilorin South Constituency.
