Court Upholds Mother's Right to Custody of Children, Rejects Father's Objection
As reported by Nigerian Tribune, an Area Court in Centre-Igboro, Ilorin, Kwara State, has granted custody of four children to their mother, Olomu Ajibola, allowing her to properly care for them.
The presiding judge, Hammad Ajumonbi, ruled that no one has the right to deny a mother access to her children, even if legal custody had been awarded to the father.
Judge Ajumonbi subsequently granted custody to the mother, noting that the father lacked sufficient evidence to dispute her claim.
The court stated that the father, however, had unrestricted access to their children and should be responsible for their feeding, school fees, medicals and general welfare.
“The parents should never take the children out of the jurisdiction of the court, except on mutual agreement of the parents,” the judge said.
He, however, said that the mother shall cease to have custody the moment she re-marries.
According to the News Agency of Nigeria (NAN), the husband had on April 16 applied for divorce and custody of their children, with the wife agreeing to this.
But he had not been allowed to see their children since then.
