Court reserves judgement in the suit seeking to halt KWASIEC fixing tax rate

In Ilorin today, Justice Sulaiman Akanbi reserved judgement to a later date in a suit seeking to stop the Kwara State Independent Electoral Commission (KWASIEC) from fixing tax payable to it by candidates participating in its midwifed November 18 local government election.

In his argument, counsel to the claimant, Salman Jawondo Esq submitted that section 318 of the Constitution of the Federal Republic of Nigeria speaks of local councils and area councils, therefore no other law can be superior to the constitutional provisions where qualifications for elections are contained.

While making their submissions Adebayo Adelodun, SAN and Kamaldeen Ajibade, SAN for the 1st and 2nd defendants respectively relied heavily on the fact that the state house of assembly is vested with the powers of prescribing payables fees for the electoral body and that the electoral guidelines are mere rehearsh of the electoral law citing section 156 of the constitution.

Justice Akanbi however reserved his judgement for a date to be communicated to all parties.
