Court dissolves marriage over husband's rudeness to mother-in-law
A Kaiama Area Court in Kwara on Thursday dissolved a 14-year-old marriage between Aishat Salihu and Sule Salihu over Sule’s rudeness to his mother-in-law.
Aishat, the plaintiff, had sought a relief for the dissolution of the marriage that was blessed with three children.
She told the court that she filed the divorce suit following a misunderstanding between her mother and the husband.
When asked on the outcome of reconciliation, the plaintiff said “my husband failed to show up for any reconciliation just as he fails to appear before the court today.
She said “my wish is to get a divorce.
“Even though I have something to claim from my husband, I will forgo it because of my children.’’
In his judgment, the presiding judge, Ahmed Yahaya, said “since the defendant has failed to show up for reconciliation, it means he is no longer interested in his wife.
“The only thing the court can do is to separate them and so I hold.
“The judgment is hereby entered in favour of the plaintiff’s plea for divorce.’’
The judge, however, ordered that the plaintiff should observe the three months Iddah (the Islamic period of abstinence before remarrying).
Yahaya said that any aggrieved party had a right to appeal before an Upper Area Court within 30 days.
